Federal authorities have condemned New York City’s sanctuary policies after a Guinean illegal alien accused of assaulting a police officer with a deadly weapon was released twice despite ICE detainers. The individual, identified as Bah, was arrested on October 7 on charges including resisting arrest, obstructing governmental administration, and intent to obtain transportation without paying. ICE lodged a detainer with Queens Central Booking that same day, but the NYPD released him without notifying immigration authorities.

This is the second time city officials ignored a detainer request for Bah. He was also released in June after a similar transportation-related arrest, despite the detainer. In a press release, DHS Secretary Markwayne Mullin directly blamed sanctuary policies for the release.

“This illegal alien from Guinea was arrested for assaulting a police officer with a deadly weapon. Despite these violent charges, New York City sanctuary politicians refused to honor ICE’s detainer and released him back onto the streets, and he remains at large,” said Mullin. Mullin called on Governor Kathy Hochul and Mayor Zohran Mamdani to end what he described as “evil sanctuary policies before another American gets hurt, or worse.”

“This is the vision of sanctuary politicians in a nutshell: the open-border policies of the Biden administration let this criminal into our country, and then sanctuary politicians in New York released him after arresting him without notifying ICE. DHS is calling on Governor Kathy Hochul and Mayor Zohran Mamdani to knock it off with these evil sanctuary policies before another American gets hurt, or worse.”

Federal officials noted that Bah had entered the United States illegally in November 2023 and was arrested by Border Patrol in Arizona before being released under the Biden administration’s policies. Bah was also arrested in January 2025 on a criminal trespassing charge and released before ICE could lodge a detainer. ICE located and arrested Bah on October 30 after a brief manhunt, taking him into custody without incident.

The agency stated that, “Sanctuary NYC released Bah TWICE despite ICE detainers, but ERO officers tracked him down through intelligence gathering and surveillance and arrested him without incident. Despite sanctuary politicians’ refusal to cooperate, the patriots of ICE got the job done and took a dangerous criminal off the streets of New York.”
