U.S. Representative Kevin Mullin, a Democrat, has introduced legislation to reclassify high-velocity BB and pellet guns as firearms, requiring them to undergo the same background checks as traditional firearms. The bill aims to close what Mullin describes as a ‘dangerous gap’ in federal law.

Legislation Targets Lethal Airguns

The proposed legislation, known as ‘Garrett’s Law,’ would require background checks for airguns that produce 800 feet per second or more in .177 caliber, as well as pellets over .25 caliber. Daisy BB Guns, a manufacturer, commented on the bill, stating that it would include models like the Daisy 880 and eventually all airguns.

Tragedy Sparks Legislative Action

In a press release, Mullin’s office highlighted a constituent’s tragic story. Garrett Edwards, who struggled with mental health during the pandemic, was legally prohibited from possessing a firearm. Despite this, he purchased a lethal airgun online and took his own life. The office argues that the bill would prevent such tragedies by closing the regulatory gap.

Support from Advocacy Groups

The bill has garnered support from gun control advocacy groups. Emma Brown, executive director of GIFFORDS, praised the legislation, calling for Congress to pass it quickly to create ‘basic guardrails’ for previously unregulated weapons. March for Our Lives, a student-led movement, also endorsed the bill.

Political and Legal Context

The proposal has sparked debate over gun control and Second Amendment rights. While proponents argue for enhanced safety measures, critics may raise concerns about the classification of airguns and the potential impact on law-abiding citizens. The legislation reflects a broader conversation about balancing public safety with individual freedoms in the context of firearm regulation.
