On Tuesday, federal prosecutors in Texas announced charges against Wilber Rafael Garces Perez, a Venezuelan illegal alien who was shot by an ICE agent during a confrontation in North Austin earlier this month. The incident, which occurred on the 7000 block of West Anderson Lane, has sparked debate over the use of force by immigration authorities.
According to court documents, Garces Perez was involved in a high-speed chase with an ICE SUV after attempting to evade arrest. The ICE agent, who was part of the Department of Homeland Security’s Homeland Security Investigations, reported that Garces Perez struck an officer with his vehicle’s side-view mirror as he tried to escape. The agent later opened fire, wounding the illegal alien.
Garces Perez was transported to a local hospital and was reported to be in stable condition. Bodycam footage from the scene shows officers gently assisting him out of the vehicle and cuffing him. The footage contradicts initial reports that suggested he was physically pulled from the car after being shot.
The federal prosecutors accuse Garces Perez of assaulting a federal officer, specifically for striking an ICE agent with his side-view mirror during the incident. The case is being handled in the U.S. District Court for the Western District of Texas, with an eight-page affidavit filed by an ICE agent detailing the allegations. The affidavit includes an account from one of the officers involved, D.F., who described how the agents began following Garces Perez after identifying him through a final order of removal.
The other officer, L.G., who fired the shot, is not included in the filing, raising questions about the full account of the incident. This case highlights the ongoing tensions surrounding immigration enforcement and the use of lethal force by federal agents.
