President Donald Trump’s Justice Department is reviewing allegations that prosecutors involved in the Watergate investigation used ‘lawfare’ to bring down President Richard Nixon over half a century ago. Former Nixon White House aide Geoff Shepard recently presented a 78-page analysis titled ‘Watergate as Lawfare’ to the DOJ’s Office of Professional Responsibility, detailing his claims that Nixon and other defendants were denied fair treatment.

Shepard’s presentation alleged that special prosecutors Archibald Cox and Leon Jaworski improperly communicated with judges and withheld evidence from defendants. Shepard had previously sought a DOJ investigation into these claims, but the Biden administration declined to pursue it in 2022. A DOJ spokesman clarified that the current development does not yet represent a formal investigation, stating that Shepard was invited to give a presentation due to his expertise on Watergate.

The reassessment comes as Republicans increasingly question the conventional narrative of Nixon’s downfall. Vice President J.D. Vance compared Nixon’s situation to the challenges faced by Trump during his first term, suggesting that Watergate was a ’12-hour news story’ that unfairly ended Nixon’s presidency. Vance also claimed that the ‘deep state’ targeted Nixon in a manner similar to efforts to undermine Trump.

Rep. Riley Moore (R-WV) took a more direct stance, declaring at the Nixon Foundation’s Grand Strategy Summit that Nixon was ‘absolutely couped out of office’ and ‘framed.’ Moore argued that the ‘deep state’ has significant power to influence top-level decisions.

Nixon resigned in August 1974 after the House Judiciary Committee approved articles of impeachment over obstruction of justice, abuse of power, and contempt of Congress. In the decades since his resignation, Nixon’s presidency has undergone significant historical reappraisal, with more focus on his foreign policy achievements and broader legacy.

Whether the DOJ’s renewed examination leads to a full investigation remains uncertain. The focus on Nixon’s downfall continues to spark political debate, with some Republicans drawing parallels to modern events.
