CNN has reported that U.S. prosecutors are considering new charges against former Venezuelan President Nicolás Maduro and his wife, Cilia Flores, over allegations of torture involving American detainees held in Venezuela. The report, citing sources familiar with the investigation, suggests the charges could be filed as early as Thursday, October 8.

Alleged Torture and Wrongful Detention

The potential charges would relate to the wrongful detention of at least 12 Americans, who were held in Venezuelan prisons during Maduro’s rule. The allegations include torture, including waterboarding, electrocution, and threats of sexual assault, as detailed in a lawsuit filed by Matthew Heath and Osman Khan, two Americans who were freed in a prisoner swap in 2022.

Other detainees, such as the ‘CITGO 6,’ a group of six American oil executives, also reported brutal treatment while in custody. They were held for nearly five years at the notorious General Directorate of Military Counterintelligence (DGCIM), which has been condemned by the United Nations for its use of torture techniques.

Current Legal Status and Defense

Maduro and his wife are currently incarcerated at the Metropolitan Detention Center in Brooklyn, following their arrest by U.S. forces in January 2026. They have pleaded not guilty to charges including narco-terrorism conspiracy and drug-related offenses. Their defense claims they are immune from prosecution as they are the head of a foreign state.

However, the U.S. does not recognize Maduro as the legitimate head of Venezuela, citing fraudulent elections and his loss in the 2024 vote. Maduro’s next court appearance is scheduled for November 17, 2026, with a full trial set to begin in June 2027.

International Reactions and Context

The allegations against Maduro and his associates have drawn international attention, particularly regarding the treatment of political prisoners and the use of detention as a tool for political leverage. The UN report on the DGCIM highlights the systematic use of torture to extract information and intimidate detainees.
