Canada has decided not to expand its Medical Assistance in Dying (MAID) program to include individuals whose sole condition is mental illness, according to Justice Minister Sean Fraser. The announcement came as Fraser emphasized the need for further discussion and safety measures before moving forward with the proposed expansion.

Fraser stated that while there is no perfect consensus on the issue, the current approach is considered the correct one at this time. The expansion of MAID to include mental illness as a sole eligibility factor has been a contentious topic for years, with previous legislation delays allowing for ongoing debate.

The original legislation, approved in 2021, was set to take effect in 2023 but was repeatedly delayed. In 2024, then-Prime Minister Justin Trudeau extended the deadline again, pushing the implementation to March 17, 2027. Fraser confirmed the Liberal government will maintain the delay through new legislation to be introduced soon.

Fraser highlighted ongoing concerns about the ability to assess MAID requests for mental illness cases safely and consistently. However, the minister also announced that Canada intends to allow adults with early-stage Alzheimer’s to make advance MAID requests to respect their wishes after they lose decision-making ability.

The decision follows a joint House of Commons and Senate committee report that urged against expanding the euthanasia program for mental health. Advocacy groups, including Dying With Dignity Canada, have criticized the delay, calling it a disappointing setback for medical assistance in dying legislation.

Critics of the MAID program have raised concerns about doctors pushing patients into euthanasia. Recent controversies include a proposed organ harvesting plan from MAID subjects and a doctor placed under supervision for breaching MAID protocols. Additionally, the case of an 83-year-old woman who died through the MAID program has sparked outrage over the procedure’s execution.
