A Haitian illegal immigrant released under the Biden administration is accused of killing a 9-year-old boy hours before his birthday party. Franck Bazil, 31, is charged with leaving the scene of an accident causing death and serious injury after allegedly striking two young brothers with his SUV.
Arrest and Charges
Authorities arrested Bazil on October 4 as he exited a car wash in Lawrence, Indiana. He is charged with leaving the scene of an accident causing death or catastrophic injury and leaving the scene of an accident causing moderate or serious bodily injury. The incident occurred around 1:30 p.m. when officers responded to a report of a child lying in the street.
The Crash and Its Aftermath
Officers found two brothers, aged 6 and 9, who had been hit by a black Ford SUV. The 9-year-old, identified as Roland Jerome “RJ” McLain III, was taken to a nearby hospital where he died. The crash happened hours before his ninth birthday party was set to begin.
Bazil’s Alleged Statements
Bazil allegedly told officers that he hit something while leaving an apartment complex and stopped briefly before fleeing out of fear when a bystander told him he had struck a child. He then drove around Indianapolis and called his relatives for advice. His family members told him to turn himself in to the police.
Family’s Belief
The boys’ grandmother, LaQuisha Moore, said she believes “RJ tried to jump in the way” and that “witnesses said he tried to save his brother.”
Legal and Immigration Background
Bazil received a Social Security card on February 29, 2024, and an Indiana driver’s license on November 8, 2025. The Marion County Sheriff’s Office noted he was mistakenly listed as an American citizen in his jail profile, which was later corrected.
ICE Involvement
ICE lodged a detainer with the Marion County Jail on the day of his arrest, requesting federal immigration custody if released. An ICE spokesperson stated that detainers are the safest way to remove criminal illegal aliens, emphasizing cooperation with local authorities.
