Disney has accused the Federal Communications Commission (FCC) of using broadcast license renewals as a tool to target its media operations, alleging the agency is retaliating against the company for its programming that has drawn criticism from the Trump administration. The accusation comes in a new federal court filing by Disney, which challenges the Trump administration’s justification for ordering early license renewals for all eight ABC-owned television stations, years before their licenses were set to expire.

FCC Investigation and Disney’s Legal Challenge

The dispute centers on whether the FCC is conducting a legitimate regulatory investigation or retaliating against a broadcaster over programming that has drawn criticism from President Donald Trump. Disney’s attorneys argue that the agency’s decision to call for early license renewals without using other available enforcement tools undermines its stated justification for the reviews.

Disney’s legal team pointed to government attorneys’ acknowledgment during an Oct. 6 hearing that other enforcement tools were available. They argued that the agency’s decision not to use these less intrusive tools, instead taking the unprecedented step of calling for early license renewals, was an attempt to apply maximal coercive pressure on the media company.

“Defendants’ own admissions leave no doubt as to why — Defendants sought to inflict maximal coercive pressure on the media company whose speech the Administration sought to curb, while deliberately evading judicial review,” Disney’s attorneys added in their filing.

FCC’s Response and Legal Justification

The FCC has defended its actions, stating that the licensing reviews are part of an investigation into whether Disney violated federal anti-discrimination laws in its Diversity, Equity, and Inclusion (DEI) hiring practices. The agency emphasized that all broadcasters have a legal obligation to operate in the public interest, including Disney.

“The FCC has been examining claims that Disney engaged in illegal DEI discrimination for over a year. Disney is obviously very concerned about the FCC’s proceeding, as evidenced by their ongoing campaign of disinformation as well as their decision to ask a court to stop the FCC from further pursuing matters. The FCC will continue to follow the facts and law wherever they lead,” the agency stated in a press release.

Disney has maintained that the Trump administration has used a federal regulatory apparatus to punish a media organization for its editorial decisions and news coverage. The company claims the process is being used to suppress free speech and influence public discourse, raising concerns about the independence of regulatory bodies in the media landscape.
