The Department of Justice (DOJ) has filed a lawsuit against the State of California, alleging that over 20,000 noncitizens are registered to vote, potentially undermining the integrity of the U.S. electoral system. The 16-page complaint, directed at California Secretary of State Dr. Shirley Weber and Los Angeles Registrar-Recorder/County Clerk Dean Logan, claims that the Department of Homeland Security (DHS) identified these names through an analysis of voter rolls and federal data.
The DOJ stated that each registered voter is automatically sent federal ballots under state law, and that thousands of these individuals had already received mail-in ballots in early October. Attorney General Todd Blanche emphasized that state-facilitated voter fraud is unacceptable in the United States, warning that if California is found responsible, it would severely undermine confidence in the electoral system and violate laws protecting the nation’s representative government.
DHS Secretary Markwayne Mullin criticized the situation, calling it “completely unacceptable,” as even a single noncitizen vote could cancel out the vote of an American citizen. He stressed that DHS is committed to identifying unlawful voting and ensuring only eligible citizens elect leaders.
The complaint also highlighted that California does not warn aliens about the federal offense of voting in federal elections. It further alleged that the state is lax in reviewing signatures on ballots, often counting ballots with an “X” rather than a name.
Mail ballots are already in most voters’ hands, and Election Day is less than three weeks away. Every count, recount, hand count, lawsuit, and audit has found that there’s no widespread voter fraud in the U.S. The Trump Admin’s last-minute demands are meritless, and we look forward to making our case in court.
First Assistant U.S. Attorney Bill Essayli for the Central District of California noted that California election officials were given an opportunity to remove noncitizens from voter rolls and sequester suspected ineligible ballots but refused. The DOJ is now taking the state to federal court to protect the votes of American citizens.
California Governor Gavin Newsom condemned the DOJ’s action, calling it a “sad” and “desperate attempt” by President Donald Trump to suppress voters just three weeks before the November midterm elections. He argued that the federal government has no role in state election processes and that the request to violate federal law is “unprecedented” and alarming.
