Erin Patterson, the Australian murderer known as the ‘Mushroom Killer,’ has lost her appeal, with the court ruling that her sentencing was too lenient and she will never be released from prison. Patterson, 52, was convicted for poisoning three relatives with death cap mushrooms during a family lunch in 2023.

Conviction and Sentencing

Patterson received three life sentences for the murders of her in-laws, Don and Gail Patterson, and Gail’s sister, Heather Wilkinson. She was also given a 25-year prison term for the attempted murder of Wilkinson’s husband, Ian Wilkinson, who survived the attack. All sentences are to be served concurrently with no parole for 33 years, and Patterson has already served 676 days in prison.

Appeal and Legal Arguments

Patterson’s lawyers argued that the sentencing was too lenient, presenting seven grounds for a retrial. Prosecutors, however, argued that the punishment was insufficient given the severity of the crime. The appeal court rejected Patterson’s appeal, stating there was no objective basis for a fair-minded person to believe the jury might have failed in its duty.

Court Rulings and Evidence

The court ruled that cellphone data indicating Patterson was near death cap mushrooms was admissible evidence, rejecting claims that it should have been excluded. Patterson had visited a nature website mapping mushroom locations in May 2022 and later visited a park in 2023, where she collected and photographed death cap mushrooms.

Events Leading to the Crime

Patterson had a dispute with her estranged husband, Simon, over child support payments. She disparaged him and his parents on Facebook, and the dispute was reported as resolved in early 2023. On June 24, 2023, Patterson hosted a lunch where she served poisoned Beef Wellingtons to her children, Simon, and his parents, though Simon declined the invitation. On July 29, 2023, she hosted another lunch where she again served poisoned food to Simon, his parents, and Heather and Ian Wilkinson, though Simon once again declined.

Judicial Statement

Justice Stephen McLeish, speaking for the panel, stated that the case involved such shocking criminality that it was inappropriate to fix a non-parole period. The court’s decision reaffirms that Patterson will spend the rest of her life in prison for her crimes.
