Parental and women’s rights groups have welcomed the Trump administration’s official rescission of the Biden-era Title IX update, which expanded the definition of ‘sex’ to include gender-dysphoric biological males. The change marks a significant shift in the interpretation of the 1972 law, which aims to prevent sex discrimination in educational institutions.

Education Department Clarifies Legal Stance

Education Secretary Linda McMahon stated that while the Trump administration had been following the 2020 Title IX rule, the formal rescission of the Biden update solidifies the reform. This decision aligns with the original intent of the law, which was not intended to address gender identity issues.

Groups Celebrate Legal Victory

Sarah Parshall Perry, vice president of Defending Education, praised the move, highlighting that the Biden-era regulation faced numerous legal challenges. “These losses were unsurprising, considering one of the rule’s many flaws — aside from being a violation of the Spending Clause, First Amendment, and Administrative Procedure Act — was an ultra vires definition of ‘sex’ to include gender identity,” she said.

Perry emphasized that Title IX was never meant to accommodate gender-dysphoric men, and the return to the original interpretation is a victory for legal and constitutional integrity.

Parents and Advocates Vindicated

Moms for Liberty expressed relief over the decision, noting that a federal judge had previously blocked the Biden-era rule, protecting girls from competing against boys in sports and sharing private spaces. “Parents were right, girls were right, and Moms for Liberty will keep standing with them until every girl in America can compete and learn in safety and fairness,” said CEO Tina Descovich.

Political Implications and Enforcement

Advocate Riley Gaines framed the change in political terms, stating that one party supports the rights of girls, while the other undermines their opportunities. She emphasized the importance of enforcement, including withholding taxpayer funding from institutions that fail to comply with the updated rules.
