DOJ Seeks TRO to Block California from Counting 20,000 Non-Citizen Ballots

The U.S. Department of Justice (DOJ) has taken emergency action against the state of California, requesting a temporary restraining order (TRO) to block the counting of 20,000 ballots sent to non-citizens. The move comes as federal authorities seek to prevent the tabulation of potentially unlawful votes ahead of the upcoming elections.
DOJ Urges Immediate Action
On Monday, the DOJ filed an emergency request for a TRO, citing the need to protect the integrity of the electoral process. The department argues that once illegally cast ballots are counted and mixed with lawful votes, the resulting harm may be irreversible. The urgency is underscored by the fundamental right to vote and the necessity of having one’s lawful vote counted without dilution.
Earlier this week, the DOJ had already put California on notice, warning that officials who tabulate unlawful ballots risk aiding and abetting a federal offense. First Assistant US Attorney Bill Essayli stated that federal agencies had identified over 20,000 suspected noncitizens registered to vote in California who had already been mailed ballots. He urged the state to temporarily segregate the flagged ballots pending citizenship verification to avoid legal consequences.
Federal Lawsuit and Verification Efforts
The emergency request for a TRO follows the DOJ’s filing of a federal lawsuit against California on October 15. The lawsuit seeks an order preventing the tabulation of ballots belonging to individuals identified as likely noncitizens until their citizenship can be determined. The Justice Department noted that Homeland Security Investigations and federal partners had examined voter-registration records and conducted additional verification work to identify potential noncitizens.
Breaking: the Trump Administration just filed an emergency Temporary Restraining Order against California — asking for CA to immediately set aside the estimated 20,000 ballots the Feds say were given to non-citizen voters. So far CA has not co-operated with DOJ request to set aside those 20k ballots until a judge can rule. CA argues in-part its a political stunt.
Trump Vows to Jail Lawbreakers
On Friday, President Trump expressed his strong opposition to the counting of ballots for non-citizens, vowing to jail those responsible if they proceed with the tabulation. He stated, “They will all go to jail for a long period of time!!!” His comments reflect the broader political tensions surrounding voter fraud allegations and the legitimacy of the electoral process.
The DOJ’s actions highlight the ongoing legal and political battle over voter eligibility and the integrity of elections in California. As the situation unfolds, the focus remains on ensuring that only eligible voters have their ballots counted, reinforcing the importance of upholding electoral standards and legal compliance.
