Kamala Harris has called for expanding the U.S. Supreme Court and taking bold, decisive action to reshape the political landscape if Democrats regain control of Congress. Speaking during a live taping of the ‘My Body. My Pod.’ podcast in New Hampshire, Harris outlined her vision for a more activist Democratic agenda, emphasizing the need to expand the Court to 13 justices, reexamine the Electoral College, and achieve statehood for Puerto Rico and the District of Columbia.
Expanding the Supreme Court
Harris acknowledged that her proposals would be controversial, particularly the call to expand the Supreme Court to 13 justices. She argued that the current 9-justice structure is outdated and that expanding the Court would allow Democrats to shift the balance of power and counter the conservative majority established by Trump-era appointments.
The expansion would require a simple majority in Congress if Democrats control both chambers and the White House, or enough Senate votes to overcome a filibuster. Critics, including some Democrats, have warned that court-packing could politicize the judiciary and undermine its historical independence.
Reforms to the Electoral College
Harris also called for a reexamination of the Electoral College, arguing that it gives disproportionate power to small and rural states. She emphasized that the popular vote should have more weight in presidential elections, a stance that aligns with long-standing Democratic priorities.
Changing or abolishing the Electoral College would require a constitutional amendment, a higher bar than court-packing, but statehood for Puerto Rico and the District of Columbia could be achieved through legislation. Both measures would add reliably Democratic Senate seats and electoral votes.
Overturning Citizens United
Harris also urged Democrats to overturn the 2010 Citizens United decision, which allowed unlimited independent political spending. She argued that the ruling has enabled unchecked influence by wealthy donors and that a new Court majority or constitutional amendment would be necessary to reverse it.
In addition to these priorities, Harris called for Democrats to be ‘ruthless’ in holding accountable those who have contributed to the current political climate. She urged the party to be ‘uncompromising’ about restoring Medicaid cuts and other priorities rather than being ‘genteel about the relationships.’
