Indiana’s high school sports board is under legal scrutiny after Attorney General Todd Rokita filed a lawsuit against the Indiana High School Athletic Association (IHSAA) over its race-based quota for board seats. The lawsuit alleges that the association’s bylaws reserve two seats for ‘qualified minorities,’ defined as individuals who are not white, violating Indiana law and promoting racial discrimination.

Bylaws Define ‘Qualified Minorities’ as Non-White Individuals

The bylaws, which have been in place since 1993, specify that ‘qualified minorities’ are individuals other than white males or females. Nominating petitions for these seats require verification of the candidate’s race, effectively excluding white men and women from these positions solely based on race.

Legal Action and State Response

Rokita’s office first demanded the removal of the quota in April 2026, but the IHSAA refused, stating it would review bylaw changes in May 2027. After further communication and an August 25 executive committee meeting that yielded no change, the state proceeded with legal action. The lawsuit seeks a permanent injunction to remove the racial quota, a ban on future race-based allocations, and a declaration that the policy violates Indiana law.

Support for Legal Action

Legal groups like the Pacific Legal Foundation and the Equal Protection Project had previously urged the IHSAA to eliminate race and sex-based screening criteria. William A. Jacobson of the Equal Protection Project emphasized that if the association does not voluntarily change its bylaws, all legal options are available.

IHSAA Defends Its Policy

The IHSAA has denied any violation of civil rights laws, stating its mission is to serve all student-athletes and member schools. The association claims its bylaws promote broad representation and diverse perspectives, which it asserts are essential for guiding interscholastic athletics in Indiana.
