California’s so-called sanctuary laws led to the release of an illegal alien drug trafficker after law enforcement ignored an Immigration and Customs Enforcement (ICE) detainer, according to a statement from the Department of Homeland Security (DHS).
Illegal Alien Released Despite ICE Detainer
ICE agents had lodged a detainer to take custody of Juan Jose Leonardo De Leon, a Guatemalan national, following his arrest for grand theft auto in Los Angeles in January 2026. However, the state’s sanctuary laws led to the detainer being ignored, and De Leon was released back into the community.
On October 19, 2026, ICE agents arrested De Leon in Los Angeles. He had previously been convicted of drug trafficking and grand theft of stolen copper materials, according to the statement from DHS Secretary Markwayne Mullin.
DHS Calls for Enforcement of Rule of Law
Mullin praised the efforts of ICE agents in arresting De Leon, stating that the Trump administration remains committed to enforcing the rule of law, deporting illegal aliens, and protecting American citizens.
“No matter how hard sanctuary politicians try to obstruct us and protect illegal aliens over American citizens, the Trump Administration will always enforce the rule of law, arrest and deport illegal aliens, and save American lives,” Mullin said.
De Leon’s Illegal Status
De Leon arrived in the United States as a legal immigrant in February 2004. However, by April of that year, he had overstayed his visa, making him an illegal alien for over 20 years.
The case highlights the ongoing tensions between federal immigration enforcement and state-level sanctuary policies, as well as the challenges faced by law enforcement in apprehending individuals who have committed crimes.
