A federal judge appointed by former President Bill Clinton has ruled against the Trump administration’s civil immigration fines, blocking the collection of penalties against undocumented aliens. The decision comes as part of a lawsuit filed by two undocumented individuals who claimed the fines violated federal law and caused severe personal and financial hardship.
Fines Targeting Undocumented Aliens
For over a year, the Trump administration implemented civil immigration fines as a strategy to encourage undocumented aliens to self-deport. As of July, the Department of Homeland Security (DHS) had issued over $84 billion in fines to approximately 103,000 undocumented individuals in the U.S.
Judge Rules Against Fines
Judge George A. O’Toole, appointed to the U.S. District Court for the District of Massachusetts by Bill Clinton, ruled in favor of the two undocumented plaintiffs, stating that the DHS violated federal law by issuing its final rule allowing the fines. O’Toole granted a stay on the fines, preventing the Trump administration from collecting them.
“The plaintiffs here face assessment and possible collection of enormous fines well beyond their capacity to pay,” O’Toole wrote. The judge highlighted the severe impacts of the fines on the individuals’ lives, including financial strain, health issues, and mental distress.
Plaintiffs’ Stories
Maria L., a nail technician with a variable salary, was fined hundreds of thousands of dollars. She reported that the fine has affected her health, increased her anxiety, caused depression, and led to her missing work for a month. Nancy M., a laborer working over sixty hours a week with two jobs, was fined over $1.8 million. She described feeling serious anxiety that has impacted her ability to sleep, eat, and live a normal life.
Both plaintiffs face the risk of wage garnishment, bank account seizure, asset confiscation, IRS reports, and future immigration complications. O’Toole’s ruling prevents the administration from enforcing these penalties at this time.
Administration’s Stance
Trump administration officials previously told Breitbart News that the fines are a critical tool for encouraging undocumented aliens to self-deport. However, the recent court decision challenges the legality and effectiveness of this policy, raising questions about its impact on vulnerable populations.
The case, Maria L. v. Noem, No. 1:25-cv-13471, is ongoing and may have broader implications for immigration policy and legal challenges facing the Trump administration.
