The Department of Justice (DOJ) has officially confirmed it will not appeal the recent ruling against suppressor registration, according to a letter from Solicitor General D. John Sauer. The decision was made after a federal court found the registration requirements for suppressors and short barrel rifles and shotguns unconstitutional in the absence of a federal tax.

The ruling, issued by U.S. District Judge James Wesley Hendrix in the Northern District of Texas, was part of a consolidated case involving multiple Second Amendment rights groups. The decision applies to current and future members of these groups, marking a significant shift in the legal landscape for firearms enthusiasts.

The case originated from the 2025 passage of President Trump’s One Big Beautiful Bill, which removed the $200 federal tax on suppressors and short barrel rifles and shotguns while leaving National Firearms Act registration requirements in place. The Silencer Shop Foundation filed the lawsuit in October 2025, challenging the constitutionality of the registration process without the tax.

On September 18, 2026, Breitbart News reported that President Trump had ordered the DOJ not to appeal the ruling. This directive was later formalized by Solicitor General Sauer in a letter to Congress, which was recently shared by the National Rifle Association (NRA). The letter stated, “I write to inform you that the Department of Justice has determined not to file an appeal in [Silencer Shop Foundation v. ATF].”

The ruling has sparked discussions among gun rights advocates and legal experts, with many viewing it as a landmark decision that could influence future legislative and judicial actions regarding firearm regulations. As the legal and political landscape continues to evolve, the implications of this ruling are expected to be far-reaching.
