The U.S. Justice Department has launched a criminal investigation into the leak of the Supreme Court’s Dobbs decision draft, which overturned Roe v. Wade. The draft was obtained by Politico’s senior legal reporter Josh Gerstein in May 2022.
Dobbs Decision and Leak Details
According to the leaked draft, the Supreme Court had voted to overturn Roe v. Wade, with Justice Samuel Alito’s opinion describing the decision as a “full-throated, unflinching repudiation” of the landmark ruling. Alito wrote that Roe was “egregiously wrong from the start” and that the decision to overturn it was necessary to return the abortion issue to elected representatives.
Justice Alito later stated that he knows who leaked the draft to Politico, calling the leak a threat to the Court. He said the leaker’s motive was to prevent the Supreme Court from overturning Roe v. Wade.
Supreme Court Report and Investigation
The Supreme Court previously issued a report on the leak, noting that the leaker could not be identified and that new protocols for handling drafts had been implemented. Over 97 Court staffers were interviewed and provided sworn affidavits denying involvement in the leak.
Despite the report, Alito said he likely knows the leaker’s identity. On Thursday, The New York Times reported that the Justice Department is pursuing a criminal investigation into the leak. The case is being led by DC US Attorney Jeanine Pirro.
