During a recent press event, New York’s top prosecutors remained silent when asked about allegations that they ordered lighter charges for illegal aliens to avoid deportation, according to a report from the New York Post. The reporter specifically asked, “Did any of you order prosecutors to downgrade gun charges to keep illegal immigrants in the US, per the Judiciary Committee report?”

James smiled and said nothing, Katz shrugged with her hands up, and staff quickly moved the event along after Katz muttered, “Our answer couldn’t help it.”

Following the presser, the attorneys again refused to address the House investigation, with James smiling without a word and Katz deferring to a spokesperson, according to a report from the New York Post. The awkward, and seemingly guilty, silence came days after the House Judiciary Committee and its Subcommittee on Immigration Integrity, Security, and Enforcement released an interim staff report titled “New York City: The Dangerous Consequences of Sanctuary Policies.”

The report states that District Attorneys Melinda Katz, Darcel Clark, Alvin Bragg, Eric Gonzalez, and Michael McMahon ensure prosecutors give preferential treatment to foreign nationals based solely on their immigration status so that criminal aliens can avoid deportation and remain in the United States indefinitely. It cites internal communications in which Katz directed prosecutors to “exercise extreme caution” and “not get caught up in the label of [f]elonies, [m]isdemeanors” when dealing with illegal immigrants, and notes that her office employs an “Immigration Specialist” to help craft “immigration-safe” plea deals.

For Bronx DA Darcel Clark, the report describes training on “Immigration-Conscious Plea Bargaining” that includes offering charges that do not include a child’s age as an element even in sex-crime cases involving minors, concealing facts from conviction records, and pursuing alternative or even “legally impossible” charges. The report also details similar policies in Brooklyn, Manhattan, and Staten Island.

A spokesperson for Katz’s office later told the New York Post that the office charges any defendant with an illegal firearm the highest possible charge under the law, regardless of immigration status. They did not answer the original question.

The Judiciary Committee noted that the NYPD received nearly 10,000 ICE detainers in the past year and honored none, and that from July 1, 2018, through June 30, 2026, the NYPD received 20,255 detainers and honored none. “Even after the American people resoundingly rejected Democrats’ pro-illegal alien policies in November 2024, Democrats across the country, including in Socialist-run New York City, reinforced sanctuary policies to ensure that the millions of illegal aliens who entered the U.S. are never removed from the country,” the committee wrote in a press release accompanying the report.
