This marks a significant departure from his previous stance during the earlier trial, where the defense focused on her criminal responsibility rather than disputing the fact of the killings.
Legal Strategy Shift
During the hearing, Reddington repeatedly asked, “Where is the evidence?” He challenged the reliability of confessions from Clancy and questioned whether she had enough time to commit the murders. Reddington also criticized the investigation as shoddy and pointed out the lack of DNA evidence linking Clancy to the crimes.
Commonwealth Rebuttal
The Commonwealth dismissed Reddington’s arguments as “laughable,” refuting his claims and maintaining the case against Clancy. Reddington’s current position contrasts sharply with his earlier defense, where Clancy admitted to the killings in a civil lawsuit and was willing to formally acknowledge her involvement if the trial were bifurcated.
Due Process and Trial Structure
Reddington also renewed his request to bifurcate the trial, arguing that combining the questions of whether Clancy committed the acts and whether she was criminally responsible may have violated her due process rights. He emphasized that many people do not understand the distinction between the two legal questions.
Legal Proceedings Continue
The court is set to address several motions, including the double-jeopardy motion and the request to preserve and review juror records. Judge William Sullivan has yet to issue rulings on these matters, and the court is scheduled to take up these issues on November 2. A new trial date may also be discussed during this hearing.
