Democratic senators have blocked Sen. Rand Paul’s attempt to compel testimony from a longtime aide to Anthony Fauci, who is alleged to have destroyed federal records on his behalf. The resolution, which aimed to secure a court order for the aide’s testimony under immunity, was voted down in an 8-7 decision, falling short of the required two-thirds majority.

Paul has been pushing for answers since Fauci stonewalled earlier this year, invoking the Fifth Amendment over 100 times during a July 29 hearing. He blamed Fauci for the records destruction and stated he would refer the matter to the Department of Justice. Paul also planned to seek the aide’s records for the past three years to investigate potential ongoing record destruction.

The aide, who worked for Fauci from 2007 to 2022, was involved in key communications during the early days of the pandemic. Records obtained through the Freedom of Information Act and congressional subpoena revealed that the authors of a scientific paper dismissing a lab origin of the virus had serious doubts about their own arguments. The aide may have been involved in destroying public records for Fauci over two decades.
Legal and ethical implications
Patricia Conrad, a special assistant to Fauci, was linked to discussions during late January 2020 to early February 2020. An email from an earlier House investigation suggested that Marge Moore, who oversaw FOIA requests, helped Fauci’s aide David Morens ‘make emails disappear.’ Morens recently pled guilty to conspiracy to commit offenses related to federal records destruction.
Reactions and implications
Paul criticized Democrats for not showing up to the hearing and voting nay by proxy, save for Ranking Member Maggie Hassan. Sen. Bernie Moreno echoed the sentiment, stating that there were more important tasks for senators than to investigate who destroyed public records.
