The Department of Justice has filed a lawsuit against the University of Delaware, accusing it of providing tuition discounts to illegal immigrants that are not entitled to them. The lawsuit alleges that the university is allowing undocumented individuals to pay the lower tuition rate reserved for Delaware residents, while American citizens from other states are charged significantly higher fees.
According to the Justice Department, the University of Delaware charges illegal immigrants $15,740 per year in tuition, the same rate as for state residents. Students from outside the state are charged $42,470. The department argues that this practice puts American citizens at a disadvantage and violates federal law.
“This Department of Justice’s efforts will not cease until we have challenged every state law or university policy that gives preferential treatment to illegal aliens over our Nation’s own citizens,” said Associate Attorney General Stanley Woodward Jr. in a Justice Department news release.
“Congress long ago made clear that states cannot give reduced tuition to illegal aliens not available to all Americans. When a state Attorney General allows her own state to violate federal law, this department must step in to enforce it,” he continued.

Assistant Attorney General Brett Shumate of the Justice Department’s Civil Division said that “this is a simple matter of federal law: colleges cannot provide benefits to illegal aliens that they do not provide to U.S. citizens.”
The lawsuit seeks to end the current policy and prevent the university from adopting new policies that disregard the law. It cites a federal law that prohibits states from offering postsecondary education benefits to undocumented individuals unless U.S. citizens are also eligible for those benefits.
The lawsuit also argues that giving undocumented immigrants a public benefit requires state legislature action, which did not occur in this case. The Justice Department has filed 26 lawsuits to stop tuition discounts for illegal immigrants, with states like Texas, Kentucky, Oklahoma, and others having to modify their policies.
Lawsuits are pending against Minnesota, Virginia, California, and other states. The department maintains that its actions are necessary to ensure that American citizens are not treated as second-class citizens in their own country.
