A federal judge has dismissed former CIA Director John Brennan’s lawsuit seeking to force the Trump administration to preserve records for his defense in the Spygate case. US District Judge Jia Cobb, a Biden appointee, ruled that Brennan lacked standing to pursue the case.

Legal Battle Over Vindictive Prosecution

Brennan’s legal team had argued that the Justice Department’s case against him amounted to ‘vindictive prosecution’ and political retaliation. However, Judge Cobb determined that Brennan had not demonstrated that the records in question were being destroyed, a key requirement for the lawsuit to proceed.

Brennan is currently testifying in the DOJ’s sprawling Spygate investigation, which has drawn significant attention over its scope and implications. The case involves allegations of misconduct related to the 2016 election, with multiple high-profile figures under scrutiny.

Broader Spygate Investigation Unfolds

In the summer of 2025, reports surfaced that former FBI Director James Comey and John Brennan were under FBI investigation over their involvement in Russiagate. Brennan is identified as the ‘target’ of a grand jury probe in South Florida, which is part of the broader Spygate investigation.

Last month, Joe DiGenova, a former US Attorney under Reagan, was appointed to oversee the Spygate probe in Florida but later resigned. Despite this, the investigation continues to move forward, according to prosecutors. Brennan’s attorneys have also been informed that he is under investigation for allegedly making false statements to Congress in 2023.

Additional Charges and Legal Scrutiny

Brennan has also been separately referred for prosecution by House Judiciary Chairman Jim Jordan. The chairman has referred Brennan to the DOJ for knowingly making false statements during a May 2023 interview with the House Judiciary Committee. This adds to the complexity of Brennan’s legal situation, as he faces multiple investigations and potential charges.
