A New Jersey school district has agreed to rescind a controversial policy that allowed school officials to keep parents in the dark about their children’s gender identities. The School District of the Chathams, in a settlement reached on October 15, dropped the policy after facing a lawsuit from Moms For Liberty and the Thomas More Society.
The policy, introduced in 2024, allowed counselors to decide whether and to what extent parents could be involved in their children’s gender transitions. This sparked legal action, with the plaintiffs arguing that the policy violated parents’ First and Fourteenth Amendment rights. Christopher Ferrara of the Thomas More Society cited two recent Supreme Court cases to support their claim, urging the district to rescind the policy.
Despite these legal arguments, the school board initially claimed the cases did not apply to New Jersey schools. School board President Ann Ciccarelli expressed this stance at a public meeting, prompting criticism from Ferrara, who called it defiance of the law. The lawsuit demanded the policy be declared unconstitutional and required parental consent for any changes in a student’s name or pronouns.
The school board ultimately voted unanimously to settle the case, agreeing not to implement similar policies in the future. The district also committed to informing teachers and counselors about its new stance on respecting parental rights. Ferrara emphasized that other districts could follow Chathams’ example or face legal consequences.
The settlement marks a significant shift in the district’s approach to student privacy and parental involvement. With the policy removed, the district aims to ensure transparency and uphold constitutional rights. This case highlights the ongoing debate over parental rights and school policies regarding gender identity, reflecting broader national discussions on the topic.
