A new report from the Department of Homeland Security (DHS) Inspector General (IG) Joseph Cuffari has revealed that under President Joe Biden and former Secretary Alejandro Mayorkas, Immigration and Customs Enforcement (ICE) knowingly allowed millions of illegal aliens who overstayed their visas to remain in the United States. The report highlights a significant lack of immigration enforcement, with many individuals classified as ‘non-priority’ aliens.
Over 3.1 Million Visa Overstay Leads Ignored
From 2021 to 2024, ICE received over 3.1 million leads on visa overstays. Among these, approximately 104,000 were classified as potential threats to national security or public safety. However, fewer than 500 of these leads were investigated, resulting in only eight arrests.
Policy Shift Led to Fewer Investigations
The report details a September 2021 directive from the Biden administration that instructed ICE agents to focus only on ‘Priority 1’ visa overstay leads, effectively ignoring millions of cases. Of the fewer than 1,800 leads considered Priority 1, only 84 were investigated, leading to just two arrests.
Challenges in Enforcement
ICE faced significant challenges in verifying addresses and locating overstayers, further compounded by a lack of resources. The report notes that the agency conducted few nonimmigrant overstay lead-initiated investigations and arrested even fewer individuals due to the limited scope of the policy.
Recent Visa Overstay Numbers
The latest visa overstay report from DHS reveals that nearly half a million foreign nationals overstayed their visas and remained in the United States in Fiscal Year 2024. This underscores the scale of the issue and the potential risks to national security.
Political Response
DHS Secretary Markwayne Mullin condemned the administration’s approach, stating, ‘The degree of the Biden administration’s dereliction of duty, which needlessly put American lives at risk, is staggering and enraging.’ Mullin emphasized that the Trump administration would prioritize American safety by targeting and removing illegal aliens.
