The resolution, brought by pro-life investors, argues that FedEx faces legal and reputational risks if its services are used to ship abortion pills. Legal and Ethical Concerns
Pro-life advocates argue that the widespread availability of abortion pills, even in states where medication abortions are banned, poses a significant ethical and legal challenge. They point to the 1873 Comstock Act, which prohibits the mailing of abortion medications, as a potential tool to combat this issue.
Industry and Legal Responses
FedEx maintains that it already has robust risk management policies in place and is committed to compliance with all laws. Similar proposals have been introduced to other shipping companies, such as UPS, with calls for stricter regulations on the shipment of abortion drugs. Indiana Attorney General Todd Rokita has urged both FedEx and UPS to establish clear prohibitions on the shipping of mifepristone, which is illegal under state and federal law.

Pro-life groups continue to push for stronger enforcement of existing laws and greater corporate responsibility in preventing the misuse of shipping services. Alliance Defending Freedom, which authored the resolution, plans to keep engaging with companies to address the risks associated with the distribution of abortion pills.
